We require you to read the Terms & Conditions for your forthcoming session with The Photo Studio Pty Ltd (TPS). We want you to know that your photographic experience will be of the highest professional standard, and that you will experience a collaborative process with the team assisting you. Each professional on the team will strive to provide a unique experience from start to finish, guiding you the entire way.
Before the fun, exciting and creative experience begins! the Terms & Conditions will let you know exactly what to expect, so there are no surprises and both the Client and TPS have clear expectations which will build trust and strengthen the relationship.
Terms & Conditions – The Photo Studio Pty Ltd (Melbourne, Sydney & Brisbane)
1. The Studio Team
For the purposes of this agreement, the Client will be assigned a Photographer, Stylist, Make-up and Hair professional and Creative Producer to ensure the Client’s requirements are fully explored and expectations understood. This is a collaborative process and Team members will engage with the Client at the appropriate steps of the process.
2. Client Confidentiality
The TPS Team maintain confidentiality and will not disclose to any third parties or make use of material or information communicated to them, except as to be reasonably necessary to enable the Team to carry out their obligations in relation to the work.
3. Acceptance of Terms
The booking and payment of the agreed deposit and/or payment plan secures the services of the Photographer for the “shoot ” (photographic session) and is non-refundable or transferable in the event of cancellation. However, the shoot can be postponed to an agreed later date up to a period of 1 year.
Any booking and payment made to The Photo Studio (TPS) indicates that you have read, understood and agreed to the Terms & Conditions as set out in this document in their entirety.
4. Price & Payments
The balance of payments is to be made in full at the time of Viewing the Images. No Photographs will be delivered until all payments due have been paid in full. Payments for additional images can be made when they are ordered.
Once your payment is complete, your order goes into production. Expect a 3-to-6-week lead time depending on the products. You’ll be kept in the loop with SMS updates as your order moves through production and delivery.
Payment options available include:
- EFTPOS: Pay directly using the EFTPOS machine with a valid credit/debit/eftpos card. Once payment is cleared, all your images will move into production.
- Cash: If you prefer to pay in cash, that’s not a problem.
- Direct Deposit: For Direct Deposit, your Creative Producer will provide you with all relevant account and transfer details. Once payment is cleared, all your photos will move into production.
- Payright: Come prepared with a deposit and pay the remainder at a pace that suits you.
- HUMM: Much like Payright but please discuss with TPS to determine whether HUMM is right for you.
- Afterpay: One of the more well-known finance providers. If you don’t have an existing Afterpay account set up, you will need to discuss the necessary requirements with TPS.
- Manual Repayment Plan: We have a manual repayment plan option that TPS can set up and tailor to you. Keep in mind that this option operates as a lay-by, thus your order will be produced only once the whole sum has been settled.
5. Arrival Time
Please make every effort to arrive on time for your “shoot” (photographic session) and please let us know as soon as possible if you anticipate arriving late. If you are less than fifteen minutes late, your session length may be reduced accordingly. If you are more than fifteen minutes late your shoot may be cancelled with no refund or, at the discretion of a TPS Team member, a new rescheduled date and time is agreed.
6. Display of Images
TPS is the owner of the Photographic images and may display any of the Photographs, as a result of the shoot, in our Studios, website, literature, exhibitions, advertising, social media or any other purpose and in any manner or medium relating to TPS business. While we believe showcasing our clients’ images benefits both parties, we respect individual preferences. To ensure clarity, we have added a marketing consent checkbox to our registration form. We are committed to honoring our clients’ wishes regarding the use of their images. However, should an oversight occur, we will promptly remove any images upon the client’s request.
7. Image Reproduction & Adjustments
All images will be adjusted for exposure, brightness, contrast, sharpness etc. The Photographer’s judgement regarding these corrections and the number of images put forward to the Client for preview shall be deemed correct. Digital manipulation and artistic finishing are available to the client as an option at extra cost.
Please note we cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials. It is at times impossible to record on film or digitally the exact colour as seen by the human eye.
8. Ownership & Copyright
Copyright is retained by The Photo Studio at all times throughout the world. Any images or copies of images whether stored digitally or otherwise and any computer program including any source code, computer files or printed documentation relating to such images will be protected by TPS in accordance with the relevant Australian Privacy Act 1988 and Copyright Act 1968.
Sometimes TPS may share with you previews of your images or give you access to an online gallery of images. These images must not be copied, screenshot, downloaded, edited or altered in any way.
If you wish to share photographs to your own network (i.e. Facebook or any other online channels) you agree to do so only once you have paid in full for the images purchased and have TPS’s express permission to do so. Any unauthorised reproduction of any Photos will constitute a breach of copyright and subject to legal action.
9. Attendance of Photographer
In the unlikely event the Photographer assigned to this shoot by TPS is unable to attend the shoot on the confirmed date, due to unforeseen circumstances, TPS reserves the right to appoint another Photographer or reschedule the appointment to a suitable date and time for the Client.
10. Cancellation Policy
When a booking is confirmed, if it is subsequently cancelled, a cancellation fee will be charged to the client according to the following schedule:
When a client cancels their appointment on the day of the confirmed date, the full fee will be charged
No refunds are given in any circumstances.
11. Force Majeure
The performance of this agreement will be contingent upon failure of energy sources, strikes by suppliers, government laws and regulations and conditions beyond our control.
12. Applicable Law
This agreement shall be governed by and construed in accordance with the laws of the state of Victoria, New South Wales, or Queensland as applicable to the Client’s location. TPS reserves the right to amend, vary, or cancel these Terms & Conditions at any time.
By agreeing to these Terms & Conditions, you acknowledge your understanding and acceptance of the terms herein. We look forward to working with you to create a memorable photographic experience which will leave its imprint on you.
